Community care legal breakthrough for trauma victims
Court of Appeal Judgment in R (SL) v Westminster City Council [2011] EWCA Civ 954

In an important judgment, the Court of Appeal has clarified the circumstances in which social services departments owe a duty to provide accommodation and support to vulnerable adults who are in need of care and attention.

Maxwell Gillott solicitors and Adrian Berry of Garden Court Chambers acted pro bono for the Medical Foundation for the Care of Victims of Torture (now called Freedom from Torture) which, along with the mental health charity, Mind, was given permission to intervene in this case.

Important New Appeal Rights for Parents

As you are no doubt aware, parental rights of appeal have been mainly limited until now to those occasions when the local authority decides to amend the statement. This has led to many occasions when parents (and schools) knew the provision was wrong, but could do nothing to get the matter finally before tribunal without calling for a reassessment. This in itself could take several years to come to a final conclusion, and if, for example, there was little change in a child’s condition (as might be the case in a child with cerebral palsy ) you could not be sure that a reassessment would be granted, let alone that provision would change.
