Oliver Studdert, Education and Community Care Law Expert

Oliver Studdert

Oliver specialises in Education and Community Care and Health Law, with a particular emphasis on young people and their rights. He also acts in Court of Protection cases. Oliver qualified with John Ford solicitors in 2005 and later moved to Fisher Meredith to continue practising in the above areas.

Oliver is a member of the Children’s Rights Alliance for England and works closely with a number of charities including The Howard League for Penal Reform, Kids Company and VOICE. He also receives regular instructions from the Official Solicitor and regularly provides training to charities and other organisations and groups.

Notable Cases:

  • R (O) v London Borough of Hammersmith and Fulham [2011] EWHC 679 (Admin)
    Oliver represented an 11 year old autistic boy in a challenge against a Local Authority’s decision to provide him with a split placement between a day school and a residential placement. The Local Authority conceded in the course of the proceedings that the placement would be provided under Section 20 Children Act 1989. However, the Local Authority maintained that this duty could be met between the two placements. The Court upheld the claimant’s challenge that the proposal put forward was irrational.
  • R (HH) v Westminster City Magistrates Court also known as HH v Italy, PH v Italy [2011] EWHC 1145 (Admin)
    Oliver was instructed by the Official Solicitor on behalf of three young children whose parents faced extradition to Italy in a case which was accepted by all involved that would effectively orphan the three children. The Divisional Court granted permission for the Official Solicitor to intervene by way of written submissions given the need in this particular case for the Article 8 rights of the children to be advanced separately to their parents.
  • R (A) v Lambeth LBC [2010] EWHC 2439 (Admin) [Part 1]
    Oliver acted for an 18 year old former relevant child. The Court held that the claimant’s Pathway Plan was unlawful. It was not a detailed operational plan as it was required to be. It did not deal adequately with the nature and level of personal support to be provided to the claimant and for details of the accommodation he was to occupy. This case has clarified the precise level of detail that such plans are required to give in identifying particular support to be provided to former relevant children.

Oliver plays football for a Saturday side and is a long-suffering supporter of Brentford FC. He also enjoys golf and skiing.
