Concern Over School Admissions

The Schools Adjudicator has reported that more than half of schools in England are failing properly to apply the law on admissions.

A review of compliance by local authorities and faith schools in all parts of the country found technical failings and poor communication with parents. One in five faith schools reviewed asked improper questions on application forms, including what the parent’s job was.

Schools were not deliberately breaking the rules, but the adjudicator’s findings suggest that many pupils will have been unfairly refused a place at their preferred school.

The adjudicator criticised the appeal process as lacking independence from the school. However, successful appeals can be lodged if you can show that the law has not been properly applied. In addition, it may be possible to take legal action in these circumstances if you fail to get a place after appealing to the Appeal Panel.

Any legal challenge must be made without delay and specialist advice is needed.
