EMPLOYMENT IN EDUCATION
Elaine Maxwell is one of very few education law specialists
who also has an expertise in employment law. A member of the
Employment Lawyers Association for 8 years, she has advised
independent and maintained schools, colleges and teachers
since 1991, on a range of issues from redundancy and reorganisations,
unfair dismissal, sex discrimination, Criminal Records Bureau
difficulties, stress at work, and disciplinary matters. Her
knowledge of the law, coupled with a practical approach to
the solution of problems in the work place can assist in the
most difficult of cases.
Teachers
Although many teachers are members of unions, some will want
independent advice, particularly where a reorganisation is
proposed. Furthermore, some teachers, particularly in the
independent sector, are not covered by any union membership.
While firm and negotiated procedures are usually in place
to deal with disputes, not all matters can be resolved easily.
In addition, many independent schools do not have such established
systems. We can help both with negotiations, and if necessary,
employment tribunal claims.
Employers
While many schools will be able to fall back on advice from
their LEA, this does not apply to all institutions. We can
advise you in the early stages of any difficulties with staff
to ensure that matters are handled properly, so avoiding the
risk of expensive litigation or claims.
